Saheli or Mydia 100 assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, Saheli will not and cannot censor or edit the content of any third-party site/app. By using Saheli, you expressly relieve Saheli and/or Mydia 100 from any and all liability arising from your use of any third-party website/app. Accordingly, we encourage you to be aware when you leave Saheli, to read the terms and conditions and privacy policy of each other website/apps that you visit/use.

Use of Saheli is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use Saheli. If you are a minor i.e. under the age of 18 years, you shall not register as a User of Saheli and shall not use Saheli.

Saheli/Mydia 100 hereby grants you permission to use application as set forth in this Terms of Service, provided that:

• your use of Saheli as permitted is solely for your personal, non-commercial use;
• you shall not copy or distribute any content, video or information of published on Saheli, in any medium without Mydia 100’s prior written authorization;
• you will comply with the terms and conditions of these Terms of Service.

• solicit login information or access an account belonging to someone else and/or bully, intimidate, or harass any user.
• post content that is hate speech, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence; is a racially or ethnically objectionable statement; is defamatory, misleading, obscene, harmful, scandalous/ libellous; or otherwise illegal or unlawful in any manner whatsoever.
• . impersonate another person; or post content that threatens the unity or integrity of India; or it’s relations with other foreign states.
• facilitate or encourage any violations of this statement or our policies.

You are solely responsible for the activity that occurs on your account, and you must keep your login id and password secure. You must notify Saheli/Mydia immediately of any breach of security or unauthorized use of your login id. Although Saheli/Mydia will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of Saheli/Mydia 100 due to such unauthorized use.

You agree not to collect or harvest any personally identifiable information, including account names, from Saheli, nor to use the communication systems provided by Saheli/Mydia 100 for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of Saheli.

The content on Saheli, including without limitation to the text, software, scripts, graphics, photos, pictorial depictions, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by Mydia 100, subject to copyright and other intellectual property rights under the relevant Intellectual Property Rights in force in India. Content on Saheli is provided to for your personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of Mydia 100, and Mydia 100 does reserves all the rights not expressly granted in and on Saheli. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein any commercial purposes. You agree not to circumvent, disable or otherwise interfere with security related features of Saheli or features that prevent or restrict use or copying of any Content or enforce limitations on use of Saheli or the Content therein.

Saheli also respects the intellectual property rights of others. We will respond to your notice(s) of alleged copyright infringement, if any, by Saheli that do comply with applicable law and are properly provided to us. If you believe that any of the videos/content posted/published on Saheli has been copied in a way that constitutes copyright infringement, please provide us with the following information: (i) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; (iv) your contact information, including your address, telephone number, and an email address; (v) a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

You agree that your use of Saheli shall be at your sole discretion and consequences. To the fullest extent permitted by law, Saheli/Mydia 100, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the application and your use thereof. Saheli/Mydia 100 makes no warranties or representations and assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our website, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein, (iv) any errors or omissions in any content/service or for any loss or damage of any kind incurred as a result of the use of any content posted or otherwise made available via Saheli, whether based on warranty, contract, tort, or any other legal theory, and whether or not Saheli/Mydia 100 is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

Saheli/Mydia 100 does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by any third party through Saheli application or any hyperlinked website or featured in any banner or other advertising. Saheli/Mydia may offer you gifts or other promotional materials in conjunction/collaboration with various third parties, and you agree to receive such gifts/promotional materials once accepted by you. You agree and confirm that Saheli/Mydia is in no way responsible for the quality or usefulness of such gifts or promotional materials, and in the event of any deficiency or defect in such gifts or promotional materials, Saheli/Mydia shall have no responsibility nor shall you have any rights to proceed against Saheli/Mydia or initiate any action against Saheli/Mydia.

The content or the views expressed therein are not intended to hurt anyone’s sentiments, religion, beliefs, morals, reputation and/or view and/or derogatory/defamatory in nature, and Saheli/Mydia 100 or any of it’s officers, directors, employees, and agents, artists, creative teams claim no responsibility/liability and/or is not liable to pay any amount towards compensation and/or damage or whatever name called, to the fullest extent permitted by law in the applicable jurisdiction.

You may be notified about the same the next time you attempt to access your account. You may also delete your account application at any time.

You will resolve any claim, cause of action or dispute, you have with us arising out of or in relating to this Statement or the Terms of Saheli exclusively in the Courts situated in New Delhi, India, and you agree to submit to the jurisdiction of such courts for the purpose of litigating all such claims. The laws of the State of India, as may be applicable for the time being in force, will govern this Statement and the Terms, as well as any claim that might arise between you and us, without regard to conflict of law provisions.

Further, if anyone brings a claim against us related to your actions, content or information posted, you will indemnify and hold us harmless from and against all kind of damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim. Although we provide rules for user conduct, we do not control or direct users' actions on Saheli and are not responsible for the content or information users transmit or share on Saheli. We are not responsible for any offensive, inappropriate, obscene, unlawful or otherwise objectionable content or information you may encounter on Saheli.

We do not guarantee that Saheli will always be safe, secure or error-free or that Saheli will always function without disruptions, delays or imperfections. Saheli/Mydia 100 not responsible for the actions, content, information, defamatory or offensive, or data of third parties, or misuse or unauthorized access, use or alteration of your content by any person whosoever, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties.
